Welcome to The Warrior Club. These Terms of Service ("Terms") are an agreement between you and The Warrior Club, a youth fitness and obstacle-training gym at 243 Alden Loop Unit A, Kalispell, Montana 59901 ("The Warrior Club", "we", "us", "our").
They cover your use of thewarriorclubmt.com and your participation, or your child's participation, in our classes, sessions, events and programs. By using the site, booking a class, buying a pass or bringing a child to train with us, you agree to these Terms. If you do not agree with them, please do not use the site or enrol.
These Terms work alongside two other documents: our Privacy Policy, which explains how we handle your information, and the Waiver and Release of Liability you sign before your child's first class. Where these Terms and the signed waiver differ on questions of risk, injury or liability, the signed waiver controls.
1. Who can use this site and enrol
You must be 18 or older to create an account, book a class, buy a pass or agree to these Terms. Our programs serve participants aged 2 to 18, and every participant must be enrolled by a parent or legal guardian who has authority to agree to these Terms and to sign the waiver on their behalf.
Children may not create accounts or submit forms on this site themselves.
2. Your account
If you create an account to manage bookings and subscriptions, you are responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly if you think someone else has access to it. Please keep your contact details, and especially your emergency contact information, accurate and current — we rely on them.
We may suspend or close an account that is used to breach these Terms.
3. The waiver comes first
Every participant must have a completed intake and waiver form on file before their first class. This is not optional and it is not something we can take verbally at the door. One form covers a child for as long as they train with us, and there is space for up to five children per household.
If you bring a younger sibling or infant along to a Parent Tot session, they need to be on a waiver too before they join in, even though there is no charge for them.
4. Classes, bookings and attendance
- Book through the site. Class availability is shown live, and a spot is only held once a booking is complete.
- Parent Tot / Courageous Cubs (ages 2–3): a parent or guardian must stay for the whole session. For all other age groups you are welcome to drop your child off.
- Dress code: comfortable activewear and clean indoor sneakers, or bare feet.
- Younger siblings and infants are welcome at Parent Tot sessions at no charge, as long as they are closely supervised by an adult and kept safe.
- Late arrival and no-shows: we do not have a fixed rule. We handle these case by case, and we would rather you tell us you are running late or cannot make it than say nothing.
- We may need to change, combine or cancel a class — for weather, illness, facility problems, low enrolment or anything else outside our control. If we cancel a class you have paid for, we will offer a makeup or a credit.
5. Prices and payment
Current prices for drop-in classes, fall sessions and monthly passes are shown on our Monthly Memberships and Plans & Pricing pages, and again at checkout. The price shown at checkout is the price that applies. We may change prices at any time; a change never applies retroactively to something you have already paid for.
Online payments are handled by our payment processor, and your card details go directly to them — see the Privacy Policy. Any applicable taxes or fees are shown before you pay.
6. Memberships and recurring billing
A monthly pass is a recurring subscription, sold as one class per week over four weeks.
Your pass renews automatically each month until you cancel. You can cancel it yourself from the My Subscriptions page, or contact us and we will cancel it for you. Cancelling stops the next payment; it does not refund the month already in progress, and you keep access for the rest of that month.
An account is required to buy a pass, because guest checkout is switched off for pricing plans, so purchasing a membership creates one.
Unused classes do not roll over to the next month. If your child misses a week, book a makeup instead (section 8). If something out of the ordinary has happened, contact us and we will look at it case by case.
If a payment fails, we may pause a membership until it is resolved.
7. Sibling discounts
We offer sibling discounts for families enrolling more than one child. Contact us before you enrol the second child and we will tell you how to claim it. Sibling discounts cannot be applied retroactively to an order that has already gone through at full price.
8. Makeups, cancellations and refunds
- Makeup classes are subject to availability. There is no time limit. Book one whenever there is room, and confirm it with us before you turn up so we know to expect you.
- We do not offer refunds unless extenuating circumstances apply. If something has happened, please contact us and we will talk it through with you.
- If we cancel a class or session you have paid for, you will be offered a makeup or a credit.
- These are our own terms of sale and they do not affect any rights you have under Montana consumer law.
9. Conduct
Everyone training here — participants and the adults with them — is expected to:
- follow the instructions of coaches and staff;
- use equipment only as instructed;
- train within their own physical abilities;
- tell staff about an injury or medical concern before participating;
- treat other participants, families and staff with respect;
- avoid reckless, dangerous or disruptive behaviour.
We may remove any participant whose behaviour we consider unsafe or inappropriate, without a refund. We would always rather talk to you first, and in almost every case we will.
10. Damage to property
You are financially responsible for damage to our equipment, facility or property caused by intentional misconduct, reckless behaviour or gross negligence. Ordinary wear and tear from normal training is on us, not on you.
11. Photography and media
We may photograph or record classes and events, but only with your consent. The intake form gives every guardian an explicit opt in or opt out, you can change your choice at any time, and the details are in our Privacy Policy.
Out of respect for other families, please do not photograph or record other people's children without their guardian's permission.
12. Assumption of risk and disclaimers
Physical training carries inherent risk. Fitness training, calisthenics, obstacle courses, strength and conditioning, agility and endurance work all involve the possibility of injury, and our signed waiver sets out those risks in detail. By enrolling a participant you acknowledge and accept them.
We are not medical providers, and nothing we give you is medical advice. Our coaches are fitness professionals, not physicians. If a participant has a medical condition that could affect their ability to train safely, consult a doctor before enrolling, and tell us about it on the intake form.
The website itself is provided "as is". We work to keep the information on it accurate and the booking system running, but we do not warrant that the site will be uninterrupted or error-free.
13. Limitation of liability
To the fullest extent permitted under Montana law, and subject to the signed Waiver and Release of Liability, The Warrior Club and its owners, coaches, employees, contractors and volunteers are not liable for indirect, incidental, special or consequential damages arising out of your use of the site or participation in our programs. Where liability cannot be excluded, it is limited to the amount you paid us for the specific class, session or pass the claim relates to.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or wilful misconduct where the law does not permit it to be waived.
14. Indemnification
You agree to defend, indemnify and hold harmless The Warrior Club and its owners, coaches, employees, contractors and volunteers from claims, damages, costs and reasonable attorney's fees arising out of your or your child's participation in our programs, your breach of these Terms, or claims brought by or on behalf of you, your family members or your guests — except to the extent such claims arise from our own gross negligence or wilful misconduct.
15. Our content
The Warrior Club name, logo, class and milestone program names, page copy, photographs and video are ours or used with permission, and are protected by copyright and trademark law. You may not copy, republish or use them commercially without our written permission. You are welcome to share links to our pages.
16. Acceptable use of the website
Please do not attempt to access parts of the site you are not authorised to use, interfere with its operation or security, scrape it in bulk, upload malicious code, or use it to harass anyone or to break the law.
17. Changes to these Terms
We may update these Terms. The current version always lives on this page with its "Last updated" date, and continuing to use the site or our programs after a change means you accept the updated version. If a change materially affects billing, cancellations or refunds, we will tell enrolled families directly rather than relying on you to notice.
18. Governing law
These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Flathead County, Montana, and you agree to that venue. If any provision of these Terms is found unenforceable, the rest stays in force.
