The Warrior Club ("we", "us", "our") runs a youth fitness and obstacle-training gym at 243 Alden Loop Unit A, Kalispell, Montana 59901. This policy explains what personal information we collect through thewarriorclubmt.com and at our facility, why we collect it, who we share it with, and the choices you have.
Most of the information we hold is about children, given to us by their parents or legal guardians. We take that seriously, and this policy describes how we handle it.
If you do not agree with this policy, please do not use our website or enrol a child in our programs.
1. Information we collect
Information you give us when you enrol a child. Our intake and waiver form collects, for the parent or legal guardian: name, email address, phone number, mailing address, relationship to the participant, and the names and phone numbers of additional emergency contacts. For each participant, up to five per household: name, date of birth, and any medical conditions and preferences you choose to tell us. The form also asks whether the participant attends Acton Academy, which we use only for our own class scheduling and never share with the school, and captures your electronic signature on the waiver and release of liability.
Information you give us when you book or request a class. Name, email address, the names of the athletes you are booking for, their age group, and the class times you prefer.
Information you give us when you buy something. When you purchase a drop-in class, a monthly pass or a membership, you provide billing details to our payment processor. We do not see or store your full card number. See section 6.
Account information. If you create an account to manage bookings or subscriptions, we hold your login email and your booking, plan and payment history. An account is required to buy a monthly pass, because guest checkout is switched off for pricing plans, so anyone purchasing a membership necessarily creates one.
Photographs and video. We may photograph or record participants during classes and events — but only with your consent, and only in the way you chose on the intake form. See section 4.
Information collected automatically. Like most websites, ours records basic technical information when you visit: IP address, browser and device type, pages viewed, and the site that referred you. See section 7.
2. Children's information
Our programs serve children from age 2 to 18, so most of what we hold is a child's information.
- A parent or legal guardian provides it, not the child. Our forms are written for and completed by an adult. We do not knowingly let children under 13 create accounts, submit forms, or give us information about themselves directly. If you believe a child has given us information on their own, contact us at the address in section 12 and we will delete it.
- We collect the minimum we need to run a class safely: who the child is, how old they are, anything about their health we need to know, and how to reach you in an emergency.
- We do not sell children's information, ever, to anyone. We do not use it for advertising, and we do not share it with anyone outside the people and services listed in section 5.
3. Health information
The intake form asks you to list a participant's medical conditions and preferences. We ask because a coach running an obstacle course needs to know about an asthma inhaler, an allergy, a prior injury, or anything else that changes how we train your child.
- We use it only to keep your child safe during activities and to respond in an emergency.
- Access is limited to the gym's owner and the person who maintains this website.
- We are not a healthcare provider, and this information is not protected by HIPAA. HIPAA applies to doctors, clinics, insurers and their business associates; a gym is none of those. We treat this information as confidential regardless, but you should know the difference.
- You can update or withdraw it at any time by contacting us — though withdrawing medical information may mean we cannot safely supervise certain activities.
4. Photographs and video
You choose. The intake form gives every guardian an explicit opt in or opt out for photographs and recordings of their child being used for promotional, educational or marketing purposes, including on our website and social media.
- If you opt in, we may use images of your child in those places. No payment is made for their use.
- If you opt out, we will not use your child's image for those purposes, and we will make reasonable efforts to avoid photographing or recording them for them.
- You can change your mind at any time. Email us and we will update your preference and stop using the images we control. We cannot always retrieve a photo that has already been shared or reposted by someone else, so please tell us as early as you can.
5. Who we share information with
We do not sell your personal information, and we do not rent or trade it. We share it only in these situations:
- Service providers who run parts of our business for us. Our website, booking system, member accounts, forms and online payments all run on Wix (Wix.com, Inc.), which stores this information on our behalf and is bound by its own privacy commitments. Our payment processor handles card and billing data (section 6).
- Emergency responders and medical personnel, if a participant is injured and needs care. The waiver you sign authorises us to seek emergency treatment.
- When the law requires it — in response to a valid legal request, or where we must act to protect someone's safety or our legal rights.
- If the business changes hands. If The Warrior Club is sold or merged, records may transfer to the new owner, who would remain bound by this policy or give you notice of a new one.
6. Payments
Online payments and subscriptions are processed by Wix Payments, which also handles Apple Pay, Google Pay, PayPal and Venmo transactions made on this site. Your card details go directly to them, are handled under their own privacy policy and security standards, and we never see or store your full card number. What we keep is a record of what was purchased, when, and by whom, so we can manage your enrolment, apply sibling discounts, and answer billing questions.
7. Cookies and website analytics
Our site uses cookies and similar technologies, provided by Wix, to:
- keep the site working — remembering your cart, keeping you logged in, and keeping the site secure. These are essential, and the site will not work properly without them.
- understand how the site is used in aggregate — which pages are visited and how people find us — so we can improve it.
As of the date of this policy we do not run third-party advertising or social-media tracking pixels on this website. You can block or delete cookies in your browser settings; if you block the essential ones, booking and checkout will not work.
8. How long we keep information
- Signed waivers and intake forms: we keep these for as long as a claim arising from a participant's time with us could reasonably be brought. Because a child's time to bring a claim generally runs from their eighteenth birthday rather than from the date of a visit, we keep a minor's waiver and intake form well beyond their last class.
- Booking, membership and payment records: as long as needed for our accounting and tax obligations.
- Account information: while your account is open, and for a reasonable period afterward.
- Marketing contact details: until you unsubscribe or ask us to remove you.
When we no longer need information, we delete it or remove the details that identify you.
9. How we protect it
Records are held in our Wix dashboard behind password-protected accounts, and access is limited to the owner and the website manager. Our website is served over an encrypted HTTPS connection. No system is perfectly secure and we cannot guarantee absolute security — but if a breach ever affects your information, we will notify you as required by Montana law.
10. Your choices
You may, at any time:
- Ask what we hold about you or your child, and get a copy.
- Correct anything that is wrong or out of date.
- Ask us to delete information, subject to records we are required to keep — a signed waiver in particular may need to be retained.
- Change your photo and video consent, either direction.
- Unsubscribe from marketing email using the link in any such message, if we ever send one. You will still receive transactional messages about your bookings, classes and billing — those are not marketing, and you cannot opt out of them while you are enrolled.
Email us at the address in section 12 and we will respond as promptly as we can. We may need to verify who you are, and that you are the participant's parent or legal guardian, before we act on a request.
11. Changes to this policy
If we change this policy we will post the updated version here and change the "Last updated" date. If a change materially affects how we handle children's or health information, we will make a point of telling enrolled families directly rather than relying on you to notice.
